Проблема правомерности молитвы в муниципальной школе [public school] начиная с 1960-х волнует общественность, прежде всего консервативных американцев, которые неоднократно настаивали на принятии федеральных законов об обязательности такой молитвы. В 1962 в деле "Энгел против Витале" [Engel v. Vitale] и в 1963 в деле "Школьный округ поселка Абингтон против Шемппа" [School District of Abington Township v. Schempp] Верховный суд США [Supreme Court, U.S.], признавая право на молитву за частными и приходскими школами [parochial school; private school], определил, что преподавание Закона Божьего и чтение молитв в муниципальных школах нарушает Первую поправку [First Amendment] к Конституции. Президент Рейган [Reagan, Ronald Wilson] предлагал принять поправку о передаче этого вопроса на усмотрение самих школ. Законы штатов о введении молитвы в школе неоднократно отвергались федеральными судами. В 1982 законодатели штата Нью-Джерси добились принятия закона, в котором обязательная молитва была названа ежедневной "минутой молчания" до начала учебного дня. К 1985 законы о "минуте молчания" [silence laws] в той или иной форме существовали в 25 штатах
